PowerMedia Gallery Terms of Service

These Terms apply to the use of PowerMedia’s external gallery, including galleries, favourites, digital download pages, and any related ordering or fulfilment services made available through third-party gallery platforms.
1. Who we are
PowerMedia is a trading name of Harry Power.
In these Terms, “PowerMedia”, “we”, “us”, and “our” mean Harry Power (trading as PowerMedia).
2. About the gallery
PowerMedia may use third-party platforms, including Pixieset, to host galleries, enable favourites, provide downloads, or process certain purchases or fulfilment activity.
Where a third-party platform is used, that platform’s own terms, privacy notices, cookie policies, and checkout conditions may also apply.
3. Website and gallery use
You must use the gallery lawfully and must not:
- attempt to interfere with the gallery platform or its security;
- gain or attempt to gain unauthorised access;
- copy, scrape, harvest, or mass-download protected content without permission;
- misuse ordering, favourites, or download functions; or
- use the gallery or website for fraudulent, abusive, or unlawful purposes.
4. Intellectual property
Unless a written licence says otherwise, all copyright and other intellectual property rights in gallery images, previews, downloads, graphics, branding, and related content remain with PowerMedia or the relevant rights holder.
Purchasing, downloading, or accessing an image does not transfer copyright.
5. Personal-use access
Unless a specific written commercial licence has been agreed, any image access, download, or purchase is for personal use only.
You must not:
- use images commercially;
- sell or resell them;
- provide them to sponsors, brands, teams, or businesses for commercial use;
- use them in advertising, merchandising, or paid promotion; or
- claim ownership of them.
6. Editing, alteration, and credit
Unless expressly agreed in writing, images must not be edited, altered, filtered, cropped, colour-graded, or otherwise modified in any way.
This includes, but is not limited to:
- applying presets or filters;
- changing colours, exposure, or composition;
- removing or obscuring watermarks;
- adding graphics, overlays, or branding.
Any editing, adaptation, or derivative use requires prior written permission from PowerMedia.
Where images are shared publicly, credit to PowerMedia is requested and expected where reasonably possible.

7. Watermarked images and previews
Watermarked previews may be viewed and, where platform features allow, shared for personal, non-commercial purposes only.
You must not:
- crop out a watermark;
- edit or alter a watermarked preview to remove branding;
- use watermarked previews commercially; or
- present them as your own work.
8. Orders, downloads, and availability
Gallery availability, image availability, favourites, and download access may change over time.
We do not guarantee that any gallery, file, or image will remain available forever unless a specific written retention or delivery commitment has been agreed.
Any delivery timing, download availability period, or purchase conditions may also depend on the gallery platform used.
All purchases are non-refundable unless otherwise agreed in writing.
9. Print, product, or checkout services
If print, product, or checkout functionality is offered through a third-party platform, the platform’s payment, fulfilment, returns, production, and platform terms may also apply.
PowerMedia is not responsible for third-party platform downtime, policy changes, or failures outside normal control.
10. Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
To the extent permitted by law, PowerMedia is not liable for indirect or consequential loss arising from:
- use of the gallery;
- inability to access the gallery;
- platform downtime;
- third-party service failures; or
- unauthorised use by another person after lawful delivery or download.
PowerMedia reserves the right to take appropriate action in response to unauthorised use, editing, or distribution of images, including requesting removal, issuing a licence fee, or taking further action where necessary.
11. Privacy
Use of personal information in connection with the gallery is described in the PowerMedia Gallery Privacy Policy. Third-party gallery providers may also process information under their own policies.
12. Changes to these Terms
We may update these Terms from time to time. The latest version will always be published on the relevant page or made available through the gallery context.
13. Governing law and contact
These Terms and any non-contractual obligations related to them are governed by the laws of England and Wales.
